III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This site is temporarily inactive due to the shutdown of the sister <br />operation Lorencito Canyon, #C-96-084. The weather was clear and cool. Snow cover was <br />limited and did not interfere with observations. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. All records <br />were found in compliance as detailed on page 2a of this report. <br />Roads <br />In addition to comments concerning roads in last months inspection report, maintenance <br />work of all roads at the site should be conducted when equipment is available in the spring. <br />Some rutting of the surfaces of the roads at the site has occurred over time due to periodic <br />truck activity related to structure demolition and storm runoff. Generally, the road surface <br />continues to shed runoff and road ditches appear to function without incident. <br />Hvdrolopic Balance <br />Pond 8 was observed partially frozen. Pond 7 was nearly dry. The sediment marker has <br />been reset in the inlet area. The stage elevation equivalent to the lowest hole on the outlet <br />riser was marked with red tape. Each stage elevation above the lowest hole was marked <br />with green tape. Pond 4 was found nearly dry and Pond 6 was dry. All pond embankments <br />appeared in good condition and no discharge was observed. The five containments at the <br />site were also found dry. The operator should evaluate these containments for available <br />sediment capacity this year. <br />Processino Waste <br />The Refuse Disposal Area was traversed on foot. The 100-year ditch appeared intact and in <br />functional condition. The ditch appears to require minor cleanout of sediment buildup, which <br />is normal given the configuration and steep slopes above the ditch. Downdrains and terrace <br />benches appeared in good condition. No slumps, slides, or damage of any kind was noted <br />on the pile outslope. <br />Fish and Wildlife <br />A small flock of turkeys were observed feeding on the recently reclaimed coal stockpile area. <br />Although turkeys are occasionally seen in the adjacent area, this is the first recent <br />observation of a flock of turkeys at this site. Generally, wildlife seems unaffected by activities <br />at the mine. <br />
