<br />III. Comments - Compliance <br />Below are particular issues wit1~ regard to any of the above compliance items. Enforcement <br />actions resulting from failure to comply with the Act, Rules and Regulations, and the permit <br />also are identified below. <br />Hydrologic Balance (4.05) <br /> <br />Because of the recent rotational landslide affecting the portal bench, the drainage <br />control system is not operational. The perimeter berm and ditch was destroyed by the slide <br />and the slide repair activities. Repair of this system is discussed under the "Problem" <br />section of this report. <br />Topsoil (4.06) <br />Large riprap of an average size of 18 inches has been placed along critical outslopes <br />of the freshwater pond to protect the topsoiled embankment from erosion. Therefore, NOV <br />83-19 has been abated. <br />Slides and Other Damage (4.12) <br />The portal bench has continued to slide with a maximum displacement of six feet at <br />this time. Movement can now be seen in the wall of the shop. Additional sediment has <br />accumulated in the sediment pond, but no damage has occurred off-site. <br /> <br />
