III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This site was idled following the shutdown and reclamation of the <br />Lorencito Canyon Mine (# C-96-084). The weather was warm and ground conditions were <br />generally dry. Although the site has received abundant rainfall lately, recent severe storms <br />did not hit this mine site. All areas were accessible by foot or vehicle. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. All records <br />were found in compliance as detailed on page 2a of this report. <br />Roads <br />Mine road surfaces were in average condition. Surface rutting has occurred in places due to <br />persistent storm runoff. Culverts along the access road to the RDA were clear of debris and <br />sediment. As noted last month, the surface and road ditches require shaping and blading to <br />restore long-term function. Road blading to improve drainage near the coal stockpile west of <br />pond 7 is also necessary south of the roadway. <br />Hvdrolooic Balance <br />Pond 7 held water to between the 5th and 6th row of holes as counted from the top of the <br />riser. The pond 7 outlet gate was found closed and the weir box at the outlet was found <br />cleaned of debris and vegetation. The three containments near the refuse conveyor were <br />holding water due to recent runoff. Pond 8 at the RDA was not discharging but water levels <br />were about one inch below the lip of the drop inlet riser. Water in the pond was very murky. <br />Repair at the emergency spillway intersection remains to be completed. The two West Mine <br />containments held small paddies of water. Pond 4 held water in the southeast corner and <br />was not discharging. <br />Perimeter ditches flanking the river were found in good condition. Culverts around the site <br />were open although sediment was evident in a number of these culverts. The operator <br />should ensure that these culverts are kept open to pass design flows. <br />Backfillino and Gradin <br />A dozer was brought to the site since the last inspection. The operator has begun to push <br />the footprint of coal stockpile #2 into a windrow along the access road. This material will be <br />disposed of in the development waste pile to the west. Following final grading, the area will <br />receive topsoil as per the approved permit. Topsoil is available in two piles immediately <br />adjacent to this area. <br />
