~LAFARG E <br />NORTH AMERICA <br />Construction Materials <br />Lafarge has checked for nesting swallows at each pile and has not found any bank swallow <br />nests. Lafazge has been in the process of reducing where appropriate the stockpile slopes from <br />neaz vertical to 1.5 to 1. Photographs are attached. Lafazge's bank swallow protection plan will <br />be as follows: <br />Prior to the beginning of each nesting season, Lafarge will inspect each pile for <br />nesting birds and determine the steepness of each stockpile. <br />Tf no birds are present, and the stockpile is determined to be steeper than 1.5 to 1, <br />then the slope angle will be adjusted to flatten the slope. <br />These procedures will eliminate future chances of bank swallow nesting in Lafazge's aggregate <br />stockpiles. <br />2. Stipulation Number 2 stated the operator would plant and maintain riparian vegetation <br />along the riverbank adjacent to the pit as suggested in the Simons Associates report <br />dated June 9, 2000. <br />Response: On May 10, 2005, Lafarge employed Habitat Management, Inc (Habitat) to <br />determine the best procedures and provide a scope of work to establish the willow plantings in <br />the vegetation gaps along the Big Thompson River as described in the Simmons's Associates <br />report. The Habitat procedures and scope is attached to this letter. Lafarge has authorized <br />Habitat to begin the plantings. On May 25"' the willow trees and soil amved on the property and <br />on May 26 2005 the plantings and tree installations along the Big Thompson River had begun. <br />Photographs aze included. <br />3. Stipulation Number 3 requires the operator provide legal right to enter easements within <br />the permit area, signed by McDowell (the owner), Magie Pie Operating Company and <br />Western Power Authority. In addition the owner of the ditch on Mr. Reicherts property <br />was in question and was to be researched by the Title Company and verification of the <br />ditch owner(s) provided to the DMG. <br />Response: The signed documents from Flatirons Company, Magie Pie Operating <br />Company, and Western Power Authority, and the title work indicating the Reichert Property <br />ditches are owned by Mr. Reichert are attached for your review. <br />LAFARGE W EST INC. -Lafarge Construction Materials <br />1800 N.
