2 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection, conducted by Joe Dudash of the Colorado Division of Minerals <br />and Geology. Bill Bear represented the operator. <br />Facilities <br />The operator is constructing the transfer tower, the downhill conveyor and the superstructure <br />joining the two stacker tubes. The reclaim tunnel is in but not the conveyor system inside the <br />tunnel. The operator will revise the plans in order to place a coal haul truck loading bin next to <br />the coal stacker tubes, on the west side of the entrance road rather than on the east side of the <br />road. In this way, the trucks can be loaded using the bin rather than using front end loaders. The <br />target date for completion of the new loading facilities is in December of this yeaz. <br />The guard rail for the new pond B will be installed soon. There were no problems observed at the <br />material storage areas. There were no fuel leaks at the fuel barn. When the conveyor belt system <br />is in place, the operator is going to run a communication line up to the water tank. Once this is <br />done, the water pump will automatically shut off when the water tank is full. At the present time, <br />the water tank occasionally overflows and the excess water runs behind the water tank bench, <br />which is not desirable for bench stability. <br />The aerial extent of the coal pile on the portal bench is right up to the limits of the surface <br />disturbance mazkers. Coal is on top of the concrete culvert box on the east side of the bench. <br />Plywood had been placed over the top grate of the box before the coal was stockpiled there. <br />Some coal has been stockpiled on the southern end of the lower reclaim bench, just north of old <br />highway 133. There were no problems with fugitive dust. Several coal haul trucks were followed <br />along old highway 133 and highway 133 and no problems with fugitive dust or excessive truck <br />speed were observed. All trucks were covered. <br />Hvdroloev <br />There was very little water in pond B. Pond D was dry. The water level in pond C was about <br />to 2 feet above the primary dischazge structure. Pond C may need cleaning in the near future. <br />The water in pond C was somewhat blackish in color. Pond embankments were stable. Pond <br />inslopes were stable as well. Pond spillways were functional. <br />
