III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The inlet to culvert R-1, at the entrance to the cuttent refuse pile, could use a little. <br />cleaning. There were some large rocks in the diversion ditch above substation no. 3. <br />However, it appears any runoff could go around the rocks. The road ditch to the west of <br />the Elk Creek topsoil stockpile could use a little cleaning. Rocks and dirt have fallen into <br />it from the cut slope. It is functional for now. There were no problems with the remaining <br />culverts and ditches. <br />Signs and Markers <br />Mine ID signs and disturbance area markers were up at the appropriate locations. The <br />operator has ordered topsoil signs for the emergency pond E topsoil stockpile and for the <br />upgradient end of the Elk Creek topsoil stockpile. <br />Topsoil Stockpile <br />There was no gullying on the topsoil stockpiles. The operator is going to consolidate the <br />topsoil stockpile at emergency pond E, and the reseed it. <br />Vesetation <br />The operator has sprayed for weeds. Most of the weeds that had been sprayed have begun <br />to wilt. However, there still is some whitetop and hounds tongue above the new refuse <br />pile, next to the upland diversion ditch. <br />At the Bear Creek reclaimed area, it appears that sheep had been grazing on the <br />revegetation efforts. <br />Refuse Pile <br />The operator has removed a considerable amount of coal refuse at the cuttent refuse pile, <br />as a base for the coal stockpile. The new coal refuse pile will probably not be used for a <br />year or so. The diversion ditches for both refuse piles had sufficient capacity. <br />c: \ms9Tsanbom\insp0699 <br />
