III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of Colorado Division of Minerals <br />and Geology. Mark Milner represented the operator. The weather was clear and dry <br />during the inspection but had been wet a few days before. <br />Facilities <br />The operator has entered the mine and is doing preparation work for a restart of mining, <br />perhaps in July. The operator is in the process of installing a water pipeline to dewater the <br />mine. The pipeline will come out of the vent shaft above the portals and travel to the area <br />of the mine dewatering pond. The operator plans on bypassing the pond, since the pond is <br />small. No mine water is being pumped out of the emergency borehole and into the <br />emergency pond E. For now, the mine water is being discharged through the normal <br />method, using the mine water dischazge pond. <br />The railroad has cleaned up the debris from their recent track work. However, the railroad <br />still has to take the debris offsite. The operator is working on restoring this area to thetr <br />satisfaction. Trees have been planted. Athree-wire fence will be installed to prevent <br />public access to the site. Some of the area next to the tracks will be graveled. <br />The retaining wall below the cemetery was still being built. There were no problems <br />observed with fugitive dust at the mine site. <br />There was no activity at the Bear Creek and Hubbard Creek reclaimed sites <br />Roads <br />All of the roads are in good shape. The roads were being watered during the inspection. <br />There were some small rocks that had fallen from the cut slope onto the light use road <br />leading to pond C. The operator is considering the possibility of using the emergency <br />roads in gulches A, B and C for a future methane degas project. The road next to the <br />portals was realigned a little bit in order to improve access. <br />Hydrolosv <br />There was a small amount of water in pond B and in the substation no. 3 pond. Pond C <br />and the Upper Hubbard Creek pond were dry. There was very little water in the <br />emergency pond E. The inslopes and outslopes have been reseeded. All pond <br />embankments appeared to be stable and spillways were functional. <br />
