II. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />begun to germinate and emerge. There are a few small patches of Russian knapweed <br />along the segment on the west side of the river that will need to be treated this fall. <br />Conveyor Corridor 2003 Areas -The remaining segment of the conveyor corridor on the <br />west side of the river from the Xcel road culvert north to Haul Road #3 was reseeded in <br />July 2003. There is good initial establishment of fourwing saltbush along most of the <br />segment, with scattered greasewood seedlings and patches of rubber rabbitbrush. <br />Perennial grass establishment is patchy at this time, and annual weedy species including <br />cheatgrass and annual torbs are abundant. <br />RSRDA Refuse Area -The parcel was seeded in November 2002. The seeding resulted <br />in an extremely dense stand of shrubs and half shrubs, dominated by greasewood, <br />forage kochia and winterfat. Greasewood density alone probably exceeds 10,000 <br />seedlings per acre. Fourwing saltbush and shadscale saltbush are present at lower but <br />significant densities. There is fair to good establishment of cool season grasses; most <br />of the grasses seem to have established within the track-hoe gouges. There is minimal <br />presence of weedy annual species (soil source was subsoil from borrow area, so there <br />would not have been a weedy seedbank). Many of the greasewood plants appear <br />stressed, with low stature and yellowish coloration. It is likely that there will be some <br />die-off associated with the extremely high initial densities. <br />~ South Fan and 2 West Porta/Areas -These small disturbed areas were seeded in fall <br />2000 and will be quantitatively sampled by the operator later this year. There is <br />generally good establishment of seeded shrubs, half-shrubs and grasses, with the <br />exception of the steep portal backfill sites at the 2 West Portals. The upper portions of <br />these slopes are largely devoid of vegetation, and mitigative treatment would appear to <br />be warranted. An evaluation of the likely causes of the failure and a plan for mitigative <br />treatment should be submitted in association with the monitoring report to be <br />submitted this year. There was evidence of fairly intensive cattle grazing at the South <br />Fan area, and a high percentage of the grass plants were clipped to ground level. <br />Grasses will as a result likely be under-represented in the sampling this year. Measures <br />should be taken to minimize grazing of the seeded areas, and in years when sampling is <br />scheduled for monitoring, sediment demonstration, or revegetation success bond <br />release demonstration, grazing should at a minimum be deferred until after vegetation <br />sampling has been conducted. Early to mid-June is generally the preferred timeframe <br />for sampling, as warm season species have made significant growth, and cool season <br />species have generally not yet gone dormant. <br />RSRDA Soil Borrow Area -This site was seeded at the same time and with the same <br />seedmix as the RSRDA refuse disposal area (November 20021. Subsoil from the soil <br />borrow area was used as the plant growth medium for the refuse area, whereas the 6" <br />topsoil Payer was scraped off the borrow area and redistributed for reclamation of the <br />
