III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion. of observations made <br />during the inspection. Comments also describe any enforcement actions-taken during the inspection <br />and the facts or evidence supporting the ehforcement action. . <br />This aerial inspection was flown on February 25, 2004. The digital pictures were reviewed on February <br />27, 2004. There were no compliance problems that were observed during the overflight. There was <br />some snow on the ground, more at the higher elevations. However, facilities azeas were cleaz of snow: <br />Facilities <br />There was a small amount of stockpiled coal on the D-seam portal bench. The Division has been <br />informed that longwall mining in the northernmost panel. D-9, is finished and that the longwall <br />equipment is being moved to the west district longwall panel WD-1. <br />Development of the B-seam bench and portals continues. Coal was being trucked out of the B-seam <br />workings and hauled by truck to the D-seam portal bench: There was continued development activity <br />on the B-seam portal bench area. <br />The coal stockpile adjacent to old highway 133 is only at one third of capacity. The work continues on <br />constructing the third stacker tube for the prepazation plant system. Straw bales for sediment control <br />off of the bench area have been installed at various locations along the work site, in order to keep the <br />highway clean during this construction phase. <br />Construction continues on the preparation plant facilities. The structural steel for the building and the <br />foundation for the circulaz tank aze being worked on. <br />There was no equipment stored on the new material storage area pad that is just west of Pond D. <br />At the gob pile, small piles of gob material were placed on the gob pile for drying. There was no <br />ponded water on top of the gob pile. The upland diversion ditch appeazed to be functional with ample <br />capacity. <br />Roads <br />The main paved haul road was dry and appeared to be in excellent condition. The gob pile haul road <br />appeazed to be somewhat dry and in excellent condition as well. <br />Slope Stability <br />Most of the mine site slopes were free of snow cover. There were no indications of geo-technical <br />instability with any of the cut and fill slopes and benches. <br />
