III. COMMENTS -COMPLIANCE <br />Below ore comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the }acts or evidence supporting the enforcement action. <br />There were no obvious signs of slope instability at any of the cut and fill slopes and at the west <br />ridge waste pile. <br />West Mine <br />Earthmoving operations continue at the west mine portal bench. Three bulldozers and one <br />compactor were working the backfilling operations. One compactor and one excavator were idle. <br />The East Roatcap Creek culvert has not been exposed yet by the excavation work. <br />The topsoil berm and the two rows of silt fence were in place on the south facing outslope. Silt <br />fence was upon the north facing slope. The contractor was using an excavator to enlarge the <br />sediment pond volume, as abatement for NOV CV-?001-003. <br />The north side of the topsoil pile was covered in snow.
