III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the }acts or evidence supporting the enforcement action. <br />This aerial inspection was flown on Friday, March 9, 2001. The digital images were reviewed on <br />March 13, 2001. There were no compliance problems that had been observed during the aerial <br />overflight. There was scattered snow in the higher elevations. <br />Train Loadout <br />A train was in the loadout area, waiting for loading operations to begin. It appeared that blackish <br />water was spilling out of the tops of the two western-most silos, running down the silo sides and <br />out into the yazd azea. However, the water did not flow very faz and was contained within the <br />sediment control system. <br />There also appeared to be some blackish water on the west side of the train loadout,just south of <br />the grizzly. Again, the water did not flow very far and all of it was contained within the sediment <br />control system. <br />One haul truck was inside the grizzly, unloading coal, and one was on highway 133, leaving the <br />train loadout. There were no signs of fugitive dust. There were no signs of coal on the highway, <br />although there was a black stain on the highway pavement. <br />Highway Coal Stockpile <br />The coal has been removed from the stockpile area, although a black residue remains. There was <br />no activity at the stockpile, except for the idle train. No signs of fugitive dust were observed. <br />The sedimentation pond had a considerable amount of water in it, close to capacity. <br />East Mine <br />Structural demolition is proceeding at a fairly rapid pace. Demolition of most of the large <br />structures is in progress. The demolition is taking place on all benches except for the fan bench. <br />There is quite a lot of structural material temporarily stored at each bench, awaiting shipping out. <br />All of the roads at the mine site appeared to be passable and in fairly good shape. There was <br />some snow on the road leading up to the fan bench. The fan bench was covered in snow. <br />
