Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the eMorcement action. <br />This was a partial inspection conducted by Janet Binns of CDMG. Mr. Rick Mills of Colorado Yampa <br />Coal Company accompanied the inspection. The weather was cleaz and warm. Mine site had received <br />rain and arrow showers during the preceding four days. <br />Operator plans to sample reference area and area 41, beginning 6/24/97, for the second year for final <br />bond release cover and production data. The pasture reference area was visited to visually assess <br />general condition of site. The pasture reference azea is not fenced and had not been grazed this season. <br />Cattle could be seen a distance to the north of the reference area. Cattle were not owned by Trout Creek <br />Ranch, and were not expected to be grazing on the reference azea. The vegetative composition of the <br />reference azea is heavily dominated by Bromus inermis (Smooth brome). Brome was approx. 6-10 <br />inches in height at the time of inspection. Litter is heavy throughout the reference area. Other species <br />observed in the reference area include: Lupirars sp., Artemesia tridentata, Rumex sp., Festuca ovina, <br />Poa sp., Achilles millefolium, Vicia americans, and occasional Astrsgalus titer. Canada thistle were <br />encountered infrequently, no other noxious weeds were noted in the reference area. Cover appeared <br />good. Bare soil was infrequent due to the heavy litter present. Grasses were not yet flowering at the <br />time of the inspection. <br />Vegetation throughout Eckman Park appeared good. No gullies noted other than reported in previous <br />inspection reports. Operator confumed that repair work to permanent drainages, roadside ditches in <br />azea 41, and grrlly East of Pond A had not. been repaired since the previous inspection. Vegetation at <br />Area 2, East of Foidel Creek RDA, is in good condition with no sign of rill or gully formation. <br />Area 41 vegetation was observed. Grasses not yet at antithesis, brome grass heights approx 6-10 inches <br />tall. Vegetation appears to be at similaz growth stages as that in the reference area. Species noted <br />throughout area 41 include Vicia sp., Poa ample, ll-Iedicago sativa, Agropyron sp., Elymus ctnereus, <br />Dactylts glomerata, Bromus sp., Rosa woodsii This species observation list is not inclusive of all <br />species on site, but a general observation of dominant species observed. <br />~ydroloeic Balance: Livestock pond 41h has not had repairs to hole in SW comer conducted yet. Pond <br />is currently holding water below the level of this hole. Operator discussed placement of bentonite in <br />hole to seal. This hole is approx. 12" deep and drains into rocks, No surface expression could be <br />determined on the outslope of the pond. Repairs to this pond need to be conducted this field season. <br />Drainage upalope from this pond appears stable. <br />Rock check dam placement along access road in azea 41 was discussed with he operator. These check <br />dame need to be placed this field season. Work was being conducted at pond A at water intake for <br />water used at the Foidel Creek mine. Contractor was not available for discussion at the time of the <br />inspection. Pond A was discharging cleaz, flow measure 0.6 on stiff at flnrne. Division of Minerals <br />and Geology measured pH 8.0, EC 2840, @ 15 °C, with hand held meters. Site 14, upstream of <br />confluence with Pond A discharge was measured. Flume at site 14 ie not level. Flow measurement will <br />be affected by this mis-alignment. Flow was approx. 1" on East side of flume, and 2'h" on West side of <br />flume. Field parameters were pH=8.0, EC= 790, temp= 10°C. Flume needs re-leveling to assure <br />accurate flow measurements. <br />
