Pa e 6 <br />MINE ID # OR INSPECTOR'S <br />PROSPECTING ID #: M-198&102 INSPECTION DATE: 09/05/2006 INITIALS: RMW <br />PROBLEM or POSSIBLE VIOLATION: PB CORRECTION DATE: November 21, 2006 <br />TOPIC S : FN <br />DESCRIPTION: The current financial warranty held by the Division in the amount of $34,640 is insufficient to <br />reclaim the site in accordance with the approved Reclamation Plan. The Division estimates that the current cost to <br />reclaim the site is $298,966 (this estimate includes the cost to import 12,550 cubic yards of topsoil). Rule 4.2.1 (1) <br />states that financial warranties shall be set and maintained at a level which reflects the actual current cost of fulfilling <br />the requirements of the Reclamation Plan. <br />CORRECTIVE ACTION NARRATIVE: Submit a replacement warranty in the amount of $298,966 or an additional <br />warranty in the amount of $264,326 to bring the total financial warranty to $298,966 within sixty days of receipt of <br />this report (estimated to be November 21, 2006). As an option, the operator may import at least 12,550 cubic yards <br />of additional topsoil to the site in order to have enough topsoil available to complete the reclamation plan. Or, the <br />operator may submit a complete application for a permit amendment to include the topsoil stockpiles at the south <br />end of the site within the permit boundary for the Thompson Resource permit (operator must verify that they have at <br />
