Pa e 4 <br />MINE ID # OR INSPECTOR'S <br />PROSPECTING ID #: M-1983-102 INSPECTION DATE: 09/05/2006 INITIALS: RMW <br />Based on the current disturbance, the Division estimates that approximately 18,550 cubic yards of topsoil will be <br />needed to reclaim the disturbed area. The amount of material available on site for use as topsoil is estimated to be <br />approximately 6,000 cubic yards. This material consists of the stockpile of wash fines and several other small <br />stockpiles of topsoil located near the northeast comer of the site. Approximately 6,000 cubic yards of topsoil has <br />been stockpiled outside of the southwest comer of the permit area. However, in the event the Division would have <br />to reclaim the site, the Division would not have access to this topsoil because it is outside the permit area. <br />Therefore, the Division would have to import approximately 12,550 cubic yards of topsoil to complete the <br />reclamation plan. The Division estimates the cost to import this amount of topsoil to be $217,866. <br />Because the cost to import topsoil is significantly higher than the financial warranty currently held by the Division, <br />the financial warranty required to reclaim the site has been recalculated. Based on the current disturbance and the <br />amount of topsoil available for reclamation, the Division has calculated a new financial warranty in the amount of <br />$298,966. (Please see attached reclamation cost estimate). This amount is $264,326 more than the current <br />financial warranty of $34,640. Therefore, the operator must submit a replacement financial warranty in the amount <br />of $298,966 or an additional warranty in the amount of $264,326 to bring the total financial warranty to $298,966. <br />As an option, the operator may import at least 12,550 cubic yards of additional topsoil to the site in order to have <br />enough topsoil available to complete the reclamation plan. Or, the operator may submit a complete application for a <br />permit amendment to include the topsoil stockpiles at the south end of the site within the permit boundary for the <br />Thompson Resource permit (operator must verify that they have at least 18,550 cubic yards of topsoil on site and <br />available for reclamation). If the operator chooses one of these options, the financial warranty could be recalculated <br />to reflect the corrective actions taken by the operator, thereby possibly reducing the required financial warranty. <br />The Division considers the matter of insufficient topsoil on site to complete reclamation according to the approved <br />plan, and corresponding insufficient financial warranty to cover the cost of importing 12,550 cubic yards of topsoil to <br />be problems that will require corrective actions. Please see pages 5 & 6 for corrective actions.
