III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Basil.Bear <br />represented the operator. There had been a rain event the night before the inspection. <br />Train loadout <br />The train loadout was out of operation for a few hours on Tuesday, August 6. A power line had <br />been accidentally severed and needed to be reinstalled. There were no coal haul trucks unloaded <br />or railcars loaded during the inspection. There were no coal spills on the tracks. <br />The hydrologic control system was functional at the train loadout. There was no standing water <br />in the sediment pond, although the bottom of the pond was wet. The bin wall was stable. The <br />spillways were functional The upland diversion ditch and culverts were functional. There was <br />some water, about 10 to 15 gpm, coming from the highway culvert and flowing through the <br />diversion ditch, into the Farmers ditch. There was irrigation water flowing through the central <br />diversion channel and culverts and, then, offsite. No problems were observed. The collection <br />ditch on the west side of the loadout and the collection berm east of the loadout entrance were <br />functional. <br />There were no fuel leaks at the double-walled fuel tank or the bermed fuel facility. The mine ID <br />signs were up at the entrances to the loadout and contained the correct information. Permit <br />boundary markers were also present. There were no gullies on the topsoil stockpile. <br />Hi lg_rwav Coal Stockpile <br />There were no gullies on the temporarily reclaimed slopes. Straw bales were up on the other side <br />of the railroad tracks. One more straw bale could be used around the west side culvert inlet. The <br />sediment pond was wet but had no standing water. The mine ID sign needs to be put backup at <br />the site entrance. <br />ROM Pile <br />The coal waste on the ROM pile has been flattened out. The operator wants to compact it further <br />to minimize the chances of any spontaneous combustion. The collection ditches and culverts <br />were functional. The sediment pond was wet but had no pooled water. The gated primary valve <br />
