III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Mike Boulay of the DMG on March 26 and Mazch <br />27, 1998. Bill Beaz representing Bear Coal Company was present during the inspection on <br />Mazch 27, 1998. The majority of the ground was clear of snow cover. Ground conditions were <br />very wet due to snowmelt and runoff'. <br />Availability of Records <br />Please update the records file with the fourth quarter 1997 Pond Inspection Reports. <br />Please repair the topsoil sign that has fallen down on the south side of the topsoil pile. <br />I`[ydro is Balance <br />The site pond was full of water at the time of the inspection but was not discharging. The culvert <br />beneath the main access road neaz the entrance to the mine site was found to be in good condition <br />and clear of debris. Site ditches were free of snow cover. The perimeter ditch located on the <br />north side of the site had running water in it and was generally well maintained. A cottonwood <br />tree has fallen down and is partially laying in the ditch east of the topsoil pile. Please remove the <br />tree from the ditch so that the flow of water in the ditch is not impeded. Coaly material has <br />accumulated in the ditch located to the north and south of the main access road in the vicinity of <br />the sediment control pond and former coal storage area, respectively. Please maintain this ditch <br />by removing the coal material. <br />A significant amount of water is flowing in the rock lined channel located on the upper and lower <br />portal benches. Discharge from this channel is pooling on the ground surface in the vicinity of <br />the former shop building. This water should be directed to an existing ditch so that it is <br />ultimately discharged to the sediment pond. One solution might be to construct a temporary <br />ditch from the former shop area to the perimeter ditch on the north side of the site. This would <br />allow the water to flow freely to the sediment control pond. <br />As noted in the previous inspection report, a portion of the water emanating from the Edwards <br />Portal Spring was not being fully captured by the 4 inch flexible pipe that discharges to the North <br />Fork of the Gunnison River. The operator did a good job at rerouting the spring discharge so that <br />all of the spring flow enters the discharge pipe. Please ensure that all discharge to the North Fork <br />of the Gunnison River continues to meet all applicable water quality standards. <br />
