CO <br />RECEIVED <br />OCT 2 3 2000 <br />Division of Minerals and Geology <br /> <br />This writing is in response to correspondence from the Colorado Division of Minerals <br />and Geology dated 8-24-00, whereas your inspector conducted a compliance inspection <br />of mining operations operated by Midway Aggregates, RLLP. The 58.06 acre azea <br />referenced in this report is Midway Tire DisposaURecycling. Midway Aggregates, RLLP <br />does not lease any aggregate extraction or mining rights within this acreage and does no[ <br />operate Midway Tire DisposaURecycling as indicated in the inspector's report and <br />therefore has no reclamation responsibility in the above mentioned azea. Contrary [o the <br />report this facility operates not only the baling recycling operation but also an ongoing <br />cover operation and is in substantial compliance with all the regulatory agencies it is <br />responsible to report to. Enclosed is a copy of correspondence from the Colorado <br />Deportment of Public Health and Environment showing that the above mentioned 58.06 <br />acres; and Midway Tire DisposalRecycling facility is in substantial compliance as of the <br />inspection date of 8-23-00 with the Colorado Regulations pertaining to Solid Waste <br />Disposal Sites and Facilities, 6 CCR 1007-2 ("Regulation") Subtitle D. <br />If you have any question, please do not hesitate to contact Midway Tire <br />DisposaURecycling, Vernie Houtchens at 719-382-3020 or P.O.
