• (Page 2) • <br />MINE ID # OR PROSPECTING ID # M-87-079 <br />INSPECTION D,1TE 11/9/98 INSPECTOR'S INITIALS AJW <br />OBSERVATIONS <br />This was a normal monitoring inspection conducted by Tony Waldron of DMG along with Rick <br />Swartwood of All Rite Paving and Redi Mix. The site is located in Lamar, Colorado just west <br />of U.S. High~day 287 and north of and adjacent to the Arkansas River. The site serves as a <br />ready-mix batch plant site as well as a sand and gravel mine. <br />According to the Mr. Swartwood, the site manager, gravel has not been mined from this <br />location for quite some time. The permitted site is mainly used as a concrete batch and <br />asphalt plant:, and materials used in these mixes are trucked in from an adjacent mine. The <br />mine site identification sign was properly posted at the entrance to the mine site and <br />boundary mar}:ers were observed at various points along the permit boundary. <br />This mine was converted from a 110 construction materials permit to a 112 construction <br />materials permit in 1995. This conversion was conducted as a result of an enforcement action <br />and the resulting Board Order which required All Rite to convert their permit as a result of <br />mining outsic.e of the 110 affected area. This converision was approved on January 23, 1995. <br />The approval of this conversion required that All Rite obtain a well permit from the State <br />Engineer's O.=fice for the evaporative loss from the pond that is now open, and to also <br />address the evaporative loss issue in the post-mining context (water rights, substitute <br />supply plan, etc.). Since none of this was submitted and incorporated into the permit <br />application F~rior to approval, the reclamation bond was calculated to include the cost to <br />obtain water rights for evaporative loss once the site was reclaimed. That reclamation <br />liability figure was $81,290.00. Once this information was submitted and incorporated into <br />the application, the bond would be adjusted to allow for the ponds to remain after mining is <br />completed. 'T'hat bond amount would be $48,050.00. <br />However, in reviewing the permit application file, it was determined that the new financial <br />warranty was never submitted and the water well permit and the evaporative loss plan was <br />never incorpcrated into the application. As a result, this is being cited as a problem on <br />page three cf this inspection report along with the necessary corrective actions and <br />timeframes fcr addressing those corrective actions which will include submitting a copy of <br />the well pera.it, the substitute supply plan, and a new financial warranty. <br />I & E Contact Address <br />NAME John P.
