III. COMMENTS -COMPLIANCE <br />Colowyo C-1981-019 <br />8 January 2007 <br />Pg 1 /9 ~~a <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br />CDRMS. The inspection was conducted on 8 and 9 January 2007. Tony Tennyson and <br />of CCC accompanied me on the inspection. Tay Tonozzi and Tony Tennyson were <br />also present on the afternoon Of 8 January 2007 for the records check portion of the <br />inspection. The mine was actively mining coal and hauling coal to the loadout at <br />the time of the inspection. The weather was cold and sunny and the ground was <br />covered with snow. <br />No documents were hand-delivered at the time of the inspection. <br />Availability of Records: All of the necessary records were available at the mine <br />office. The records are in the records room. Please see the DBMS Availability of <br />Records form at the end of this inspection report for more detailed information <br />regarding the required records. <br />Signs and Markers: -All of the necessary signs were in place as required at the time <br />of the inspection. Mine ID signs were in place at all of the ponds along Colorado <br />Highway 13 as required. <br />Roads: -The access road and haul road to the Gossard Loadout is a paved road. <br />The road was well maintained and in good condition. <br />- The light-use road in Taylor Draw to the West Pit Pond and East Taylor Pond was <br />stable and well maintained at the time of the inspection. There were some ruts and <br />muddy/wet areas from the melting snow but overall the road was in good condition. <br />-The haul roads in the East and West pit areas were all well maintained and stable at <br />the time of the inspection. The roads were dry but there were no problems with <br />fugitive dust at the time of the inspection. No erosional problems were noted on <br />these roads. The main haul road was closed as the 103 dragline was walking to the <br />B-Seam at the time of the inspection. <br />-The light-use roads around the Gossard Loadout and to the rail loop were well <br />maintained and in good condition. <br />-The roads to and around the Section 16 Pit and pond were not accessible at the <br />time of the inspection due to snow. <br />-The roads in the West Pit for access to the highwall miner and former Bower project <br />were all frozen and appeared to be stable at the time of the inspection. These roads <br />run along the west edge of the West Pit and up to the top of the section 16 Pit on the <br />west side. No erosional problems were noted on these roads at the time of the <br />inspection. <br />
