There is mining disturbance attributed to the previous permittee <br />beyond the permit boundaries to the north. This area lies between <br />and is linked with areas of excavation by the current permittee. <br />Although the current permittee is not considered to be in violation <br />for the disturbance outside the permit boundary, he is, with the <br />transfer of the permit, considered to have assumed the obligation <br />to reclaim this disturbance. <br />CORRECTIVE ACTION: The permittee should commit, in writing, to <br />reclaim the disturbance attributed to the previous permittee <br />according to the requirements of the approved reclamation plan. <br />~ 6. There is an overhead utility line crossing the permit area <br />with supports located within the permit area boundaries in <br />locations that may be directly and adversely impacted by the <br />mining operation. There is no agreement in the permit package <br />to compensate the owner of this line for any damage brought about <br />by the mining operation and the mining plan does not make any <br />provision to prevent impacts to the line. <br />CORRECTIVE ACTION: The permittee should either secure a compensation <br />agreement with the owner of the utility line or modify the mining plan <br />to demonstrate that the line and its supports will not be damaged by <br />the mining operation. <br />7.
