• (Page 3) • <br />MINE ID # OR PROSPE TING ID # H-x7-146 I^~ <br />INSPECTION DATE~3~Qq INSPECTOR'S INITIALS V(7 <br />particular concern to this inspector is the disturbance beyond the northwest permit area <br />boundary, just east of the topsoil stockpile. The permittee's representatives indicated that <br />this area had been mined by the previous operator and was not intended to be included in the <br />current operation. This area, however, lies between areas obviously being excavated by the <br />current permittee and is linked to them. It would be difficult to reclaim the current <br />disturbance without including this adjacent area. Although the current permittee would not <br />normally be considered in violation for this disturbance beyond the permit boundaries, the <br />Division does consider the current permittee, with the transfer of the permit, to have <br />assumed the responsibility to reclaim this area. The disturbance did occur after the permit <br />was issued. This is a compliance problem that will be included on Pave 5 of this report. <br />There is an overhead utility line crossing the permit area, supports for which lie within the <br />permit area and in locations where they may be adversely impacted by the mining operations. <br />It is uncertain if the permit for this operation was issued before or after this line was <br />installed but it is clear that there is no agreement in the permit package between the <br />permittee and the owner of this line to provide compensation for any damage to the line <br />brought about by the mining operation and the mining plan does not make any provision to <br />prevent damage to the line. This is a compliance problem that will be included on Page 5 of <br />this report. <br />The current financial warranty for the site is considered, at this time, to be insufficent <br />to complete the approved reclamation plan. This is a compliance problem identified during <br />the Division's inspection on 9/10/98 but for which a corrective action date has not been set. <br />Re-evaluation of the reclamation cost for the pit is in progress by the Division. When this <br />re-evaluation is completed and should any insufficency be identified, the permittee will be <br />notified and provided 60 days in which to address the matter. This remains a compliance <br />problem that will be included on Page 5 of this report. <br />Comments by the permittee's representatives and consultants during the inspection indicated <br />that the current post-minimg land use wildlife habitat, and the corresponding reclamation <br />plan may no longer be considered appropriate for the site. The post-mining land use and the <br />mining and reclamation plans for the current 110 operation could, of course, be changed by <br />means of an amendment. If, in addition, more of the local property is eventually to be mined <br />during the course of the operation than is encompassed by the 110 permit area, conversion of <br />the current permit to a 112 could not only provide for a larger permit area but also could <br />be employed to propose changes in the post-mining land use as well as the mining and <br />reclamation plans. <br />I & E Contact Address <br />cc <br />NAME:Mr. John P.
