III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />(ln Fahri~ary 1, 1994 a complete inspection was conducted at the permanently <br />reclaimed Canadian Strip Mine. Randall Price of Minerals & Geology and Edsel <br />Pough of OSM conducted the inspection. This inspection was an OSM <br />oversight inspection. The last oversight inspection at this mine was on March <br />30, 1993. Amine representative was not present during this inspection. <br />The inspection started at about 9:45 a.m. at the Jackson County Courthouse <br />with a check of the publicly available records. All records required to be kept at <br />a publicly accessible location were on file. However, two concerns were noted <br />during the records check. <br />1. The riI! and gully surveys were conducted in June an July for <br />1992 and 1993 respectively; in the permit application, the mine commi[ted <br />to conducting the rill and gully survey in May of every year. The rill and <br />gully reports for 1992 and 1993 were submitted later than June, the month <br />committed to in the permit application. The lateness of the survey did not <br />delay gutty repair since no gullies were reported and the mine conducted <br />repair and lnterseedfng on April Z9, 1993 of areas that showed erosion or <br />insulfcient vegetation. This repair work was as effectfve in detecting and <br />repairing erosion areas as the rill and gully survey. <br />The Canadian Strip mine should revise the permit to reflect that a spring <br />survey of erosional features on the reclaim area will be conduced as soon <br />as the snow melts and that appropriate maintenance will be pertormed. <br />The repair work should be documented in the annual reclamation report. <br />2. The private surface lease for this mine expired in 1986. At the <br />lime of the inspection there was a concern about maintaining right of <br />entry, but a review of the lease in the Division office showed that there <br />was language in the /ease to continue the terms of the lease after the <br />expiration. <br />The inspectors accessed the mine by snowshoe. The mine averaged a foot of <br />snow, with drifts being deeper. A loop was made around the reclaim area. <br />
