(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1981-207 <br />INSPECTION DATE 4-30-2003 <br />INSPECTOR'S INITIALS SSS <br />This was a routine monitoring inspection conducted as part of DMG's ongoing monitoring program for permitted mines in <br />Colorado. <br />The mine identification sign and affected area boundary markers are in place and in compliance with Rule 3.1.12. <br />No significant infestations of noxious or other problematic weeds were noted on site during this inspection. <br />No significant erosional features were noted on the affected areas of the site. <br />Mining has progressed to the eastern permit boundary and is heading back to the west, lowering the pit floor by another bench. <br />Backfilling of the south and east highwalls is partially accomplished. Overburden from the north stockpile is being transported <br />to the east highwall for placement. The north topsoil stockpile will be placed on the buffer area at the top of the east highwall <br />allowing for excavation toward the north boundary while mining toward the west. This is a very clean, organized operation. <br />The reclamation cost estimate was not recalculated as part of this inspection. The current estimate was recalculated less than <br />three years ago and the operation is, for the most part, incompliance with the approved mine plan and reclamation plan. Any <br />potential shortfall in the current reclamation bond amount will be determined through the technical revision process, required to <br />be submitted to DMG, to correct on-site problems noted below. <br />Fill material has been imported to the site for use as permanent structural fill. DMG records do not indicate that the notice <br />specified in Rule 3.1.5 (9) has been submitted for this backfill importation and placement. Please submit this notice by the <br />correction date specified in the Problems section of this report. If significant amounts of additional fill material are to be <br />imported to the site for use as permanent structural fill, a technical revision should be filed with DMG to incorporate plans into <br />the permit with specifications for fill importation, including the certification and information required by Rule 3.1.5 (9). <br />A few fuel tanks and several drums or other containers of hazardous material were noted in various areas about the permit <br />area that were not stored inadequate spill containment. Specifically, one diesel fuel tank for the crusher operation was located <br />in the active pit and one fuel tank was located at the concrete batch facility. Additionally, several various sized containers <br />assumed to contain hazardous materials such as hydraulic fluid, antifreeze, oil, waste oil, etc. were stored around the concrete <br />batch facility and near the scales/office area. One very large diesel fuel tank was located north of the concrete batch plant <br />within a substantial concrete spill containment structure. However, this structure has not been incorporated into the permit and <br />costs for demolition and disposal of this structure are not included in the reclamation bond. <br />All containers of hazardous material must be stored in adequate spill containment, approved by DMG. To comect the problems <br />regarding lack of spill containment and installation of spill containment structures that are not approved permit features, the <br />operator must either remove all containers of hazardous materials from the site and remove the unpermitted spill containment <br />structure, or submit a technical revision to incorporate the design specifications and reclamation details for all spill containment <br />structures to be constructed. Additionally, if hazardous materials are to be stored on site, the permit must be revised to include <br />a commitment to report any reportable spills to DMG as well as the appropriate jurisdictional agency (see enclosed policy for <br />acceptable wording of commitment).
