III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The gate was locked at the entrance to the West Portal area. The three portals were blocked with <br />screen. Most of the equipment has been removed. No liquids were at the fuel storage facility at the <br />main mine site. The were no fiigitive dust problems observed at the train loadout. <br />Hydroloev <br />There were no discharges at the NPDES points. There was a little water in pond 1. The water level in <br />pond 2 was up to the weep holes but was not discharging during the inspection. The pond 3 water level <br />was 4 feet below discharge. Pond 4 was dry. The gated valves for ponds 1, 2 and 3 were open while <br />pond 4's was closed. The pond at the highway coal stockpile was nearly full and needed to be pumped <br />out. The pumped water would flow into the train loadout pond. There was no water in the train loadout <br />pond. There was only a little water in the ROM pile pond. At the West Portal, the water level in the <br />pond was 3 feet below discharge. The West Ridge waste pile pond was close to discharging, although <br />it is nit an NPDES point. No problems with sediment levels were observed. Embankments and bir. <br />walls appeared to be stable. Spillways were functional. <br />At the haul road to the West Mine, afrer it departs from the Steven's Gulch road, the bottom culve:~ <br />and the two culverts at the top of the hill need some cleaning at the inlets. The road ditch at the bottom <br />of the hill, near the intersection with the Steven's Gulch road, needs some maintenance. <br />At the main mine site, the ditch behind the warehouse needs some cleaning. A few rocks have fallen <br />into the ditch. On the east side of the crusher\screener bench, there are two notches in the berm that <br />need to be tilled. Otherwise, coal fines could be washed onto undisturbed land. On the same bench, <br />during the inspection, the operator fixed the bales that surround the drop structure. The culvert leading <br />to the pond at the West Portal needs cleaning at the inlet. <br />Straw bales were up at the highway coal stockpile SAE. The silt fence on the bench outslope of the <br />West Portal area needs some minor repair. At the main mine site, the silt fence at the vent fan bench <br />needs repair. The other silt fences were in good condition. <br />To soil <br />No gullying was present on any of the topsoil piles. Topsoil piles were fairly well vegetated. All of the <br />topsoil signs were up. <br /> <br />
