GENERAL PROVISIONS <br /> 1.1 Purpose. It is the intent of this overlay district to identify and regulate a special <br /> area of significance where mining has historically occurred and will most likely <br /> continue to occur. No mining activity shall be established within the defined <br /> Cripple Creek Mining Overlay District (CCMOD) until the Teller County Board of <br /> County Commissioners grants approval of the proposed activity through the <br /> Planned Unit Development (PUD) process, according to the special conditions <br /> and approval procedures described herein. Each specific proposal for <br /> conducting additional mining operations that have not previously been approved <br /> by Teller County within the Overlay District shall be subject to a separate review <br /> and permitting process. <br /> 1.2 Relationship to other Land Use Regulations. These regulations have been <br /> developed to address certain aspects of large-scale mining operations that may <br /> be less adequately addressed through the general PUD process or other <br /> regulatory mechanisms provided for in the Teller County Land Use Regulations. <br /> It is intended for these regulations to be comprehensive, and that they <br /> supersede other standards and requirements contained in the Land Use <br /> Regulations for mining PUDs within the CCMOD. However, in the event that <br /> these specific regulations do not adequately address circumstances or matters <br /> that may arise for mining PUDs proposed within the CCMOD, the more general <br /> provisions contained in the Land Use Regulations will govern. No additional <br /> criteria, standards or submittal requirements are intended to be incorporated by <br /> this paragraph, but other general provisions of the Land Use Regulations are. <br /> 1.3 Previous approvals. Any prior approvals under existing and valid Conditional <br /> Use Permits (at the date of adoption of the CCMOD) are not modified by the <br /> CCMOD Regulations, unless and until they are incorporated into a CCMOD <br /> approval in the future. <br /> Section 2. USES <br /> 2.1 Permitted uses: <br /> 2.1.1. Permitted uses in the underlying zone in compliance with the Teller <br /> County Land Use Regulations. <br /> 2.1.2. Mining-related Operations, when specifically described in the approved <br /> PUD and associated with an approved PUD, consist of: <br /> a. Prospecting - includes but is not limited to, sinking shafts, tunneling, <br /> CCMOD - Effective May 25, 2000 1 <br />
