A storm water management plan <br /> submitted in conjunction with State of Colorado permitting requirements <br /> may, subject to the determination of the County Engineer, satisfy this <br /> requirement. <br /> It is recognized that the interpretation of an "adverse' impact, and <br /> the prescribed method of mitigation, varies depending on site-specific <br /> circumstances. It is the responsibility of the applicant to demonstrate to <br /> the reasonable satisfaction of the County that off-site impacts are either <br /> not adverse, or that they have been adequately mitigated in accordance <br /> with generally accepted engineering practices. Mitigation may also be <br /> satisfied through innovative methods, including the establishment of <br /> agreements with downstream landowners who could be impacted by an <br /> increase in water surface elevation (provided erosion and sedimentation <br /> concerns are also adequately mitigated). <br /> 7.3.3 Reclamation. The reclamation plan is consistent with the County's long- <br /> term growth and conservation plans for the area. <br /> 7.3.4 Visual Character. Site will be developed with minimum disruption of the <br /> natural character of the surrounding area. <br /> Site disturbances must be reclaimed in accordance with an approved <br /> reclamation plan approved by the DNR, with the exception of mining <br /> structures approved for "provisional historic status." <br /> 7.3.5 Highways. Impacts to highways shall comply with applicable State and <br /> federal requirements. <br /> Section 8. SITE DESIGN REQUIREMENTS - the following Site Design requirements must be <br /> met for a PUD in the CCMOD for mining. <br /> 8.1 Building design. New or expanded buildings and structures that are visible from <br /> beyond the boundaries of the CCMOD shall be constructed of materials and <br /> color that blend into the surroundings so as to reduce contrast, considering the <br /> function and readily available options for construction materials. <br /> 8.2 Driveway and access. In accordance with the Roadway Design and <br /> Construction Standards, where County roads are involved and in accordance <br /> with State and federal regulations where other highways are involved. <br /> 8.3 Easements. In accordance with the Teller County Land Use Regulations, EA-10, <br /> Easements. <br /> 8.4 Height (of structures) - Consistent with standards established for the underlying <br /> Agricultural (A-1) zone, the height limitation for buildings or other structures <br /> within the CCMOD is 50 feet. Exception to this standard is made in the following <br /> circumstances: <br /> CCMOD - Effective May 25, 2000 17 <br />
