506476 06/27/2000 11:45AM Paqe 16 of 28 <br /> Connie Joiner, Clerk s Recorder, Teller County, Colorado <br /> previously surface mined; extension of leaching areas, either into new <br /> locations or increase in height above previous approvals; and/or <br /> expansion of overburden storage into areas that have not been previously <br /> surface mined, the applicant shall submit renditions of before, during and <br /> after views of representative viewpoints determined by the Planning <br /> Department in consultation with the Applicant. <br /> 5.10 Owner consent - Written consent from all landowners whose properties are <br /> included within the proposed PUD. <br /> 5.11 Sewage information - Applicant shall comply with local, state, and federal <br /> standards and submittal requirements for sewer and septic systems. <br /> 5.12 Takings study - If the applicant objects to any property dedication or money <br /> payment requirement contained in these Regulations on the basis that the <br /> Requirement is illegal as not being roughly proportional to the impact caused by <br /> the proposed development, the applicant shall, within 30 calendar days of receipt <br /> of notice of the dedication requirement, and in any event prior to the hearing on <br /> the application, notify the Planning Official in writing and provide an independent <br /> consultant study by a Colorado licensed engineer on what the applicant believes <br /> would be the maximum legally supportable requirement. <br /> 5.13 Third party review - The Planning Director may require third parry review and <br /> special review fee for any item submitted as part of the application for which the <br /> County lacks (a) expertise on staff and (b) has regulatory and/or review authority. <br /> The Applicant and Planning Director shall agree upon the selection of the third <br /> party, cost, scope of work, and schedule. Scope of work is limited to checking <br /> for compliance with regulations and codes for accuracy of the calculations, <br /> adequacy and completeness of the information submitted, and review of the <br /> preparation under generally accepted professional practices. All agreed upon <br /> costs of the third party review shall be paid by the applicant. <br /> 5.14 Waiver - The minimum standards for development are those shown in these <br /> Regulations. Waiver of the non-PUD standards may be granted by the Board of <br /> County Commissioners, on the recommendation of the Planning Commission, on <br /> written notice and justification by the developer and/or builder. <br /> 5.15 Water information <br /> 5.15.1 Ground Water Information. An assessment of the effect of the proposed <br /> mining operations on ground water quality with emphasis on the potential <br /> for, and the management or control of, adverse impacts on ground water <br /> quality. This analysis may be an updated report based on prior <br /> assessments of the ground water system in the Cripple Creek Mining <br /> Overlay District or a new evaluation. The applicant shall provide any <br /> reports on projections or evaluations of the area-wide ground water quality <br /> CCMOD - Effective May 25, 2000 12 <br />
