III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br />Jerry Nettleton (Nettleton) of Twentymile Coal Company (Twentymile) accompanied Byron Walker (Walker) <br />of the Colorado Division of Reclamation, Mining and Safety (Division) during this inspection of the Foidel <br />Creek Mine. Ms. Danielle Domson of the Colorado Division of Wildlife was present for the part of this <br />inspection that covered the facilities area, especially with regard to the Technical Revision 59 Application, <br />and effects of subsidence in the 18-Right Ventilation Shaft area (otherwise undisturbed region). Her interests <br />were primarily with regazd to the effects of the operations on wildlife, including the effects of discharges on <br />fish. There was about a foot of snow over most azeas of the site. <br />SIGNS AND MARKERS <br />Signs on public roads onto the site were in place and in good repair. Although surface blasting is complete, <br />some blasting sign were still up at some entrances to the permit area. <br />ROADS <br />Roadways were thawed and damp. The Routt County Road 27 interchange with the west Haul Road was <br />nearing completion. The interchange is still not in use by mine traffic. <br />HYDROLOGIC BALANCE <br />Impoundments B, D, E, F and G were snow covered or frozen over. Pond C was clear of snow and ice and <br />contained some water. Pond T was not inspected. Pond E at the Fish Creek Tipple was covered with snow. <br />The Area 1 Pit Impoundment was free of snow and ice. There was no dischazge from the Area 1 Pit <br />Impoundment. Although no surface runoff was observed, there has been (reported by Nettleton) discharge <br />from some of these ponds. <br />BACKFILL AND GRADING <br />There has been no reclamation backfilling and grading accomplished since the last inspection. <br />PROCESSING WASTE <br />Processing waste was being transported to, and deposited at, the coal mine waste disposal area. The waste pile <br />was in good repair. <br />SUPPORT FACILITIES <br />The truck loadout tower appeared to have been closed in. It was still not in use. <br />The truck scale on the haul road to RCR 27 had been set. It was not in use. <br />The site of a proposed second wash plant was inspected. <br />The ring foundation for the water tank at the 6 Mains North Ventilation shaft had been completed.
