III. COMMENTS • COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken dunng the mspeclion <br />and the facts or evidence supporting the enforcement action <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology (Division). The purpose of the inspection was to follow-up on final reclamation <br />work recently completed in association with a pending Phase Il/lll bond release application <br />(SL-05) submitted by Energy Fuels Mining Company (EFMC) and currently under review by <br />the Division. A. J. luppa was present during a brief period dunng the inspection. The <br />weather was very windy but ground conditions were excellent and access was good to all <br />areas. <br />Signs and_Markers <br />A.J. luppa requested that the operator leave the mine identification sign at the main gate for <br />future use by the landowner. The sign was found in-place. <br />Hvdroloclic Balance <br />The inspection began at permanent ditch <br />no. 5 (PM-5) located south of the <br />reclaimed topsoil stockpile footprint. This <br />permanent ditch was not inspected during <br />the bond release inspection conducted on <br />September 21. Flow in thrs ditch ties <br />together natural flow from arroyos above <br />and below the reclaimed area. The ditch <br />blends well into the terrain and had been <br />recently seeded and mulched. <br />The former location of the surface flume in <br />the permanent diversion channel was <br />found seeded and mulched, as shown in <br />the photograph below. <br />Additional sediment removal was <br />requested in the 100-year ditch above the <br />shop. especially along the riprap portion <br />of the ditch. Siltation from above the <br />ditch was measurable at a number of <br />locations. Thrs portion of ditch was <br />traversed on foot and found clear of <br />excess sediment as required. <br />. ~ - .may _ <br />- ` nom". _~~ ~.`~ •^'~'~r"~-. <br />_:t .. ,~. <br />
