(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-208 <br />INSPECTION DATE 6/24/04 <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the Lyons Quarry conducted by Erica Crosby and Harry Posey of <br />the ivision of Minerals and Geology. John Lohr and Eric Hodek of CEMEX, Inc. were <br />present during the inspection. The purpose of the inspection was to take water samples at <br />the C-Pit and inspect the portions of the Lyons Quarry that have been reclaimed. <br />Water Sampling of the C-Pit <br />CEMEX notified the Division on May 17, 2004 of a potential exceedance of the numeric <br />protcection level (NPL) for selenium based upon sampling conducted on April 16, 2004. The <br />results indicate the presence of selenium at 0.069 mg/L which is above the 0.02 mg/L NPL <br />established by the permit under Technical Revision O1 (TR-O1). The Division notified <br />CEME7~: that the sample might be in error due to the analytical method. The lab report <br />indicates selenium was measured by the total selenium method. However, selenium is <br />regulated based on dissolved selenium. The change from total to dissolved method was <br />effective by the December 30, 2001 regulations for the basic standards for groundwater <br />(Regulation No. 41) administered by the Colorado Department of Publio Health and the <br />Environment (CDPHE) Water quality Control Commission. <br />CEMEX resampled the C-Pit water on June 2, 2004 using the analytical method of dissolved <br />selenium. On June 21, 2004, CEMEX reported the results of the sample at 0.186 mg/L. In <br />both samples no selenium was detected in the A-Pit which is down gradient from C-Pit. <br />Due to the exceedance of selenium in the C-Pit, the Division obtained water samples from <br />the C-Pit to be evaluated at the laboratory at the Colorado Department of Health and the <br />Environment (CDPHE). CEMEX obtained a split sample to run at a lab of their choice. Apparent miscommunication at check-in caused holding times for nitrate-nitrite to be <br />exceeded. Harry Posey told lab to run them anyway since they would provide minimum <br />numbers <br />2. Extremely high TDS of sample subjects Gross Alpha and Beta to extreme errors. Harry <br />Posey Y.old lab to not run these. <br />3. ~~RUSh" turnaround time is 14 days. <br />Prior t:o water sampling in the C-Pit, the DMG and CEMEX met to discuss the selenium <br />concentrations in the C-Pit. CEMEX stated the pump from the C-Pit to the cement plant was <br />non-operational from 9-12 months, which may have increased the concentration of selenium <br />as evaporation occurred. During that time, water from the A-Pit was used to sprinkle the <br />cement kiln dust (cxD). The pump has since been fixed, and elevated on a platform to <br />prevent the suction of sediment from the floor of the pit. <br />
