III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />Unit Train Loadout <br />All three entrance gates were open and each gate had a mine ID sign on it. The three paved entrance roads were <br />in good condition. No new reclamation has occurred at this site since the last inspection. The demolished <br />concrete silos were crushed into gravel-sized pieces for use at the Bowie No. 2 Mine. The operator continues to <br />draw from this pile of gravel. Several pieces of mine machinery are sitting on the site. Several pieces of <br />equipment from the Union Pacific are also on site. <br />The sediment pond was dry. The upland diversion ditch and culverts were functional. The pond's bin wall <br />embankment was in good condition. The primary discharge pipe gated valve was in the closed position. The <br />Farmer's irrigation ditch, which flows through a culvert underneath the pond, was flowing full as well. Silt fence <br />or a berm might be a good idea on the east side of the site to make sure debris from the demolition area won't <br />find its way into the Farmer's Ditch, should a large precipitation event occur. Currently, it is not a problem. <br />The Loadout site's central upland diversion ditch and culvert system was functional. There was irrigation water <br />flowing through the system. There were some broken branches lying in the upland diversion ditch that leads east <br />from the east side entrance gate. These branches need to be removed. The west side collection ditch was well <br />vegetated and had sufficient capacity. The half culvert downdrain was functional. There are two small patches of <br />whitetop in this area that need to be sprayed. <br />Run-of--Mine (ROM) Stockpile <br />The graveled haul road at this site was in very good condition. The mine ID sign was up at the entrance. The <br />culverts and ditches were all functional. There was only a little standing water in the sediment pond. The pond <br />embankment was well vegetated. There were only three very small pools of water on top of the pile. The pile <br />outslopes were well vegetated. <br />Well Field <br />The mine ID sign was up at the entrance and surface disturbance markers defined the disturbed area. The <br />entrance road was dry and passable. There were no problems at the pump house. The topsoil stockpile was well <br />vegetated and the topsoil sign was up on the pile. <br />Records <br />The records were in compliance.
