III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the <br />operator during the field inspection. Basil Bear represented Bowie Resources during the records check. <br />West Mine <br />The backfilled area has a good vegetative cover and there were no indications of slope instability or erosional <br />problems. The road to the site was in good condition and the mine ID sign and surface disturbance markers were <br />up. The upper sediment pond was dry. The gated valve was open, as designed. The lower sediment pond had a <br />little standing water in it. This pond's gated valve was closed, as designed. The ponds' embankments were <br />stable and spillways were functional. The silt fence and straw bales around the site were functional but repair is <br />needed soon. There was a large patch of thistle in the northeast corner of the backfilled area and some thistle <br />was also starting to grow at the fan site. <br />East Mine <br />The front gate to the east mine was closed and locked. The mine ID sign was up on the gate. The paved haul <br />road was in very good condition, although there were small rocks on the road. The access road to the portal <br />bench also had quite a Few small rocks on it and in the road ditch but it, too, was passable. However, the light <br />use road up to the utility bench was not passable by vehicle due to the many rocks on the road. <br />There has been some recent reclamation work at the east mine. Some of the concrete and asphalt have been <br />broken up on the warehouse bench. Concrete has also been broken up at the waste oil site. Some of the steel at <br />the substation is now on the ground. <br />Benches appeared to be stable. Bench outslopes were well vegetated and highwalls were stable. Topsoil <br />stockpiles had fair to good vegetative cover. Topsoil signs were up. There were no signs of slope instability or <br />erosional gullies on the West Ridge waste pile and the old waste pile. <br />The sediment control system was functioning properly. Culverts and ditches had capacity although a lot of small <br />rocks were in road ditches and in the ditch on the west side of the warehouse bench. All of the sediment ponds <br />were operational. Only the bin wall pond that is second from the top had any water in it. The other ponds were <br />dry. The spillways of the ponds were functional and pond embankments and pond bin walls were stable. <br />Hi way Coal Stockpile <br />The coal at this site has been removed and the area was covered with dirt and seeded. The mine ID sign was up <br />at the entrance. The dirt entrance road was in good condition. Surface disturbance markers were up around the <br />site. The cut slope was well vegetated and appeared to be stable. The flat area had recently been covered with <br />additional dirt so the area did not have a good vegetative cover. This flat area needs to be seeded. The sediment <br />pond at this site was dry. The west side culvert inlet was protected by straw bales. On the west side of this area, <br />a patch of whitetop is growing and needs to be sprayed. <br />
