III. COMMENTS -COMPLIANCE <br />Beiow are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear represented <br />the operator. The weather was dry but the site received an intense stone just a few days ago. The <br />longwall is in the B-seam and is fully operational. <br />Main Mine <br />There were no recent rockfalls behind the rock catchment berm. The berm appeared to be very stable <br />with no evidence of any movement. The outside berm on the utilities bench was in place. The ditch to <br />the rear of the utilities bench will need some maintenance soon, however. The seep just to the west of <br />the utilities bench was wet but not flowing. The road up to the utilities bench was in good condition. <br />No problems were observed with the D-seam portal bench facilities. There were no leaks at the fuel <br />bam. There was only a small amount of coal that was stockpiled on the D-seam portal bench and there <br />were no problems with fugitive dust. There were no signs of cut and fill slope instability except with <br />the small slump above the haul road just before you enter the D-seam portal bench azea. The slump is <br />getting a little bigger but does not present any hazard or problem at this time. The operator has done an <br />excellent job of backfilling, grading and seeding the azeas disturbed by the construction of the <br />conveyor system from the B-seam portal bench to the D-seam portal bench. The culverts and ditches <br />were functional and the material storage areas were in good order. The cap and powder houses were <br />locked. The paved haul road up to this bench was in good condition and the guazdrail was in place. <br />At the B-seam portal bench, the berm on the outside edge of the bench was intact. There was no <br />slumping of the highwall, although some matting had been placed above the portals for erosion <br />control. On the other side of the haul road, the excess material stockpile appeared to be stable, <br />erosionally and geotechnically. <br />The main topsoil stockpile was well vegetated. Topsoil stockpile signs were up. The collection and <br />diversion ditches had sufficient capacity. No problems were observed at the adjacent material storage <br />azea. <br />The cut slope above the wash plant, including the repaired small slump azea, was stable. The culverts <br />and ditches in this area were functional. There was a moderate amount of coal stockpiled on the coal <br />stockpile bench. There were no problems with fugitive dust or tracked coal dust on the highway. Straw <br />bales were present for erosion control. Culverts and ditches around the entrance area were clear. <br />There were only a few inches of standing water in pond B. The inlet hose was connected to its float. <br />The emergency spillway had sufficient capacity. The pond embankment and inslopes were stable. <br />Surface disturbance markers were up around the disturbed azea. New mine ID signs were up. <br />
