Dear Mr. Ary
The Division conducted a site inspection of the Evans Pit # 2 on.8y25/07.Prior to the
site inspection on 1A'/23/07 the Division received a fax from Miss Denise Gonzales of
Fremont Paving & Redi Mix requesting an increase in the affected acres from 50 to 80 .
When the site was succeeded in 2006 from RC Evans to Fremont Paving and Redi Mix, with
the type of options you selected, the Division was supposed to calculate the needed
warranty based on the approved reclamation plan with in 60 days.
However the required warranty calculation was never completed. Enclosed you will find a
copy of the inspection report and the detailed Financial Warranty CALCULATION FOR THE
PRPOSED 80 ACRES that you will be affected. The current warranty for the site is
$50,000.00. The calculated warranty for the proposed affected 80 acres is
$226,196.OO.You must submit the additional warranty in the amount of $176,196, no later
than October 8, 2007.
