III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on July 13, 2005 by Mike Boulay <br />of the CDMG. Weather conditions were sunny and hoi. Ground conditions were dry throughout <br />the mine site. George Patterson of Energy Fuels Coal, Inc. was present during the entire <br />inspection. Kent Crofts of IME was also present at the site conducting Year Nine Revegetation <br />Sampling and interim reclamation sampling. <br />Sins and Mazkers <br />The mine and permit identification sign at the entrance to the site along the permanent light use <br />road has become illegible and needs to be replaced. Please replace this sign as soon as <br />practicable. <br />Roads <br />The permanent light use road was dry and the entire site was accessible. Significant erosion is <br />occurring on the road at approximately .2 miles inside the entrance gate. The road is also rutted <br />at approximately .9 miles inside the gate. Please maintain the permanent road by grading <br />particularly in locations where erosion is occurring. <br />HvdroloQic Balance <br />The road ditch along the west side of the permanent road is down cutting in some azeas <br />particulazly in locations across from Pond D on the west side of the road. If the ditch continues <br />to erode, some rock may be necessary to armor the ditch. Also on the west side of the road at <br />the inlet to the culvert that flows to Pond D, water is beginning erode the channel and skirt <br />azound one side of the check dam. Please make necessary repairs to the permanent light use road <br />ditch and rock check dam above the culvert inlet to Pond D. <br />Some erosion is occurring below the confluence of PDl and PD 2. Water appeazs to be skirting <br />out of the ditch just below the confluence and down cutting and forming a gully. The erosion <br />should be backfilled and graded. A rock-check dam may also be necessary to control the flow <br />and keep runoff in the designed ditch. <br />There is significant erosion in PD4 below the culvert crossing that will require maintenance. <br />Down cutting and gully formation is occurring, the erosion is worse below the last rock check <br />dam. Please repair the erosion that has occurred in the PD4 drainage. The CDMG recommends <br />placing additional rock armoring in the PD4 ditch. <br />
