2 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by several members of CDMG. The emergency drill <br />pads and roads associated with the mine fire were inspected by Larry Routten and Joe Dudash <br />on September 13, 1999. The records check was done by Joe Dudash on September 13, 1999. Jim <br />Burnell of CDMG did the field inspection of the mine site on September 16, 1999. The <br />inspection was accompanied by Mazk Milner of Oxbow Mining Co. The mine site was active. <br />The weather was warm and sunny. <br />Siens 8c Markers: A sign needs to be added at the top (uphill)side of the Elk Creek Canyon <br />topsoil pile. <br />Roads: The roads were all in very good condition. The haul road for the Elk Creek mine (the <br />Cemetery Road) was in excellent condition. THe rock buttresses were in place and stable. That <br />road near the old slide was also in good condition. <br />The Hubbard Creek road was in good condition after the recent rains. <br />The emergency dill pads and their associated roads were inspected. The pads and roads were <br />holding up rather well. There were no signs of gullying, in spite of the steepness of the roads. <br />However, the water bars will need to be reworked before winter sets in. Also, debris has to be <br />removed and the site seeded before winter. <br />Hvdroloeic Balance: <br />The pond at the bottom of the West Valley fill was muddy and holding water.' All the ditches <br />were open and functional. A strong flow was entering the minewater pond (150 gpm). The pond <br />a- itself was covered with algae. At the fan site, a mudflow had plugged the culvert during a recent <br />thunderstorm. That ditch had been cleaned and the culvert was in the process of being <br />.' unblocked. The substation 3 pond contained several feet of muddy water, also a result of the <br />recent thunderstorm. Springs 10 and 11 weren't found. They appear to be dry this year (and <br />have been all summer.) The facilities azea pond was undergoing cleaning during the inspection. <br />There was some standing water at the east end of the pond. The Hubbard Creek Canyon pond <br />was dry. <br />On Sep 15, an inspection was made in response to a citizen complaint to the DMG office. The <br />complaint concerned discharge of water into the North Fork of the Gunnison River from the <br />
