III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DMG staff from the <br />Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. No <br />activities at the coal mine were observed; no individuals were contacted during the inspection. This <br />inspection focused on the areas addressed under a request for reduction of permit acreage and <br />financial warranty (SL-02), submitted by the permit holder. Three maps and 21 photographs <br />accompany this report. <br />Under SL-02, the permit holder has requested release of 64.51 acres from the permit area and a <br />$150,416 reduction in financial warranty, for lands duplicatively regulated under the Colorado Surface <br />Coal Mining Reclamation Act and the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, 34-32.5-101 et seq., C.R.S. According to the permit holder, the lands <br />addressed under SL-02 are also permitted under the Ewing Mesa Pit No. 1, Permit No. M-1992-116. <br />However, discrepancies exist between the boundary of lands addressed under SL-02 and the permit <br />boundary for M-1992-116. These discrepancies are illustrated on three maps, enclosed with this <br />report. The first map (8 inches x 10 inches and 1 inch = 400 feet scale) is a copy of the map <br />submitted with SL-02, with dashed lines to indicate the approximate locations of the second two maps, <br />Map A and Map B. Maps A and B (11 inches x 17 inches and 1 inch = 100 feet scale) show the <br />location of the permit boundary for M-1992-116 and the approximate boundary of the lands addressed <br />under SL-02. The maps indicate a discrepancy between the referenced boundaries of approximately <br />2 (+/-)acres. Therefore, not all lands addressed under SL-02 appear to be duplicatively regulated <br />under the Coal and Construction Materials Act and Rules. <br />The circled numbers on Map B correlate with photos 1 through 11 and show the approximate locations <br />of the equipment in the photos. As shown on Map B and the accompanying photos, significant coal <br />related equipment, and disturbance associated with the equipment, exists within the boundary of SL- <br />02, for which reclamation has not been completed.
