November 3, 2005 <br />Central Appalachian Mining, LLC (CAM) <br />P.O. Box 98 <br />Loma, CO 81524 <br />McClane Canyon Mine <br />Complete, oversight inspection <br />November 1, 2005 <br />Participants: <br />Walter Whitledge, (CAM) <br />Dan Matthews, Colorado Division of Minerals and Geology (DMG) <br />Henry Austin, Office of Surface Mining (OSM) <br />Iparticipated in a complete, oversight inspection of the McClane Canyon Mine with the above <br />on November 1, 2005. The DMG-OSM Oversight Team selected this mine for evaluation during <br />the 2006 evaluation year. The primary purpose of the inspection was to evaluate offsite impacts, <br />and no offsite impacts were documented during the inspection, or as a result of reviewing the <br />records of required environmental monitoring on this permit area. <br />Mr. Matthews began the inspection by briefing me on aDMG October 25, 2005, partial <br />inspection he conducted here. Mr. Matthews conducted the October 25 inspection here to <br />evaluate any effects from heavy rains in this area the week of October 16 to 22 and most likely <br />from thunderstorms on October 18. At least one-half inch of rain was recorded at the mine <br />during this period, resulting in high velocity-sediment laden flowsrn all primary and secondary <br />drainages on the undisturbed areas above the mine facility pad at the portals area. The 2 primary <br />drainages are diverted beneath the facility pad through 42" corrugated metal pipes (cmp), and <br />some associated secondary drainages are also diverted into the primary cmp's through smaller <br />diameter cmp. These cmp diversions were overwhelmed by the thunderstorm(s); and as a result <br />of Mr. Matthew's October 25 inspection, notice of violation (NOV) CV-2005-008 was issued for <br />failure to maintain upland diversion culverts, and a haul road culvert, in accordance with <br />approved designs and applicable performance standards (culverts or cmp's D, E, and H). <br />The required abatement is to restore design capacity to the affected cmp's by November 9, 2005. <br />The permittee had several workmen busy hand-cleaning the cmp's as ordered by the above <br />NOV, and they appeared to be making steady progress under the circumstances (hand labor). We <br />inspected the upper facility pad and the work being performed, and walked down the haul road, <br />inspecting the road ditches, road culverts, and the small area exemptions (sae) that treat nmoff <br />from the mine office and parking ~~eas. <br />Mr. Matthews modified the NOV to include one road culvert which needed sediment removal <br />that was not cited in the NOV. In addition, Mr, Matthews noted to Mr. Whitledge a few other <br />areas (some sections along the haul road ditch-south side, the silt fencing on the office area- <br />parkinglot sae, and the inlet area to the sediment pond) that needed routine maintenance to <br />function as designed. Mr. Whitledge agreed to maintain the areas noted. <br />
