III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the Inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill <br />Bear represented the operator. <br />Facilities <br />Bowie Resources has started construction of the train loadout. Heavy equipment was <br />moved onsite at the extreme east end of the project area, off of Old State Highway 133. <br />Topsoil salvaging operations began, moving east to west. An excavator and three haul <br />trucks aze being used in the salvaging operation. Topsoil is being trucked along a road <br />constructed in the disturbed area to the topsoil stockpile azea. The contractor was <br />removing about 30 inches of topsoil but had left behind a fair amount of topsoil. The <br />contractor will bring in a dozer and salvage the remaining topsoil for the topsoil pile. <br />The disturbed azea for this portion of the construction is upgradient from the existing <br />railroad tracks. Sediment control in this area consists of the railroad track bed and silt <br />fence and straw bales placed in front of the inlets to culverts that go underneath the <br />railroad tracks. Once the topsoil is stripped, the east end cut will be placed as fill to the <br />west. Then, the approved sediment control ditches can be established to flow into <br />sediment ponds. <br />The contractor was stripping topsoil for a haul road in the disturbed azea to build Pond K. <br />Once this pond is built, work on the loadout structure will begin. The contractor has not <br />built Pond J yet. <br />There were no problems with any of the other facilities. There were no leaks at the fuel <br />facility. The explosives cap and powder houses magazines were locked. There were no <br />fugitive dust problems along Old State Highway 133 at the mine entrance or in front of <br />the coal stockpile, which was very lazge in size. The coal stockpile on the portal bench <br />was fairly small in size. <br />Roads <br />The paved haul road was in good condition. Guazd rail was properly installed. The <br />operator built up the berm along the gob pile haul road, as required by MSHA. The road <br />was in good condition. The access road to the water tank bench was in good condition as <br />well. Light use roads at higher elevations were snow covered. <br />
