Marr 6/92 page 2 <br />MLRD issued an order to Kerr as a result of this inspection requiring them to <br />permit two road segments that had previously not been permitted. The road from <br />the county highway to the loadout has a paved surtace and is maintained by Kerr <br />well enough that I did not see any pertormance standards problems. This land is <br />owned by Louisiana Pacific and Kerr has an easement from them to use it. Since <br />this is a private road and Kerr is the sole user, it must be permitted. The other <br />piece of road is that segment from county road 12 to the existing gate at the mine <br />site. This used to be a county road but was dropped from the county records <br />when Kerr started mining the site. Kerr and Jackson Co., have an agreement that <br />allowed Kerr to build a by-pass road, and reclaim the old road. As such, this .5 <br />mile section of road is used solely by Kerr, is no longer a public road, and must be <br />permitted. Mr. Kent Crowder, the Jackson County Administrator, was contacted <br />about the history of the roads in the mine area. <br />The site is in fairly good condition, but the greatest concern I had when I first saw <br />the site was contemporaneous reclamation. There are two large pits open; one at <br />the south end and one at the north end of the disturbed areas. The spoil pile was <br />built with scrappers and contains about 5.5 million cubic yards. Kerr appears to be <br />in compliance with the approved permit requirements. Technical Revision 8 <br />requires Kerr to backfill 300,000 cy annually in the southern pit. The 1990 annual <br />report shows that Kerr backfilled 467,000 cy and the 1991 report shows 440,100 cy <br />were backfilled into the south pit. MLRD recently recalculated the volumetrics of <br />the open pits and the spoil pile. This information was not available at the mine, but <br />the inspector said that the calculations show adequate spoil available for <br />reclamation. <br />The last blasting at the mine was done 7/15/91. There are only eight blasting <br />records from 1991. The blasting schedule was published 3/27/92, with the <br />blasting times every other hour starting at nine thirty in the morning. <br />The ponds were certified 5!7/81, and the haul road was certified 5/8/87. <br />Some conditions existed that are not currently a violation, but could develop into <br />violations if left unaddressed. The CMP west of pond B is starting to pipe and <br />erode at the outlet. The embankments of most of the ponds are not adequately <br />vegetated. The seeding efforts have not been very successful because of the <br />material that the embankments are made from. Well 79-1 also needs to be <br />backfilled. A 3" PVC pipe comes out of the 12" borehole and the hole is still open. <br />Water is apparent about 25' down the hole. <br />
