COMMENTS • COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />dunng the inspection. Comments also describe any enforcement actions taken dunng the mspeclion <br />and the facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (CDMG). This former underground mine is reclaimed. Remaining <br />buildings and structures are approved to remain as permanent features. Ground conditions <br />on this day were dry and the weather was breezy and mild. <br />Availability of Records <br />The public copy of the mine records is kept at the office of the Las Animas County Clerk at <br />the county courthouse in Trinidad. All required records were easily located. Details of the <br />records inspection can be found on page 2a of this report. <br />Hvdrolooic B <br />The sediment pond held water up <br />to the principle spillway user. The <br />pond was not discharging at the <br />time of the inspection. Prior to <br />final bond release, the the <br />approved plan calls for raising the <br />principle spillway riser about two <br />feet and lowering the emergency <br />spillway to a prescribed elevation. <br />This will increase storage to about <br />two acre-feet. The Division <br />suggests planning these activities <br />for early fall if a bond release <br />application wdl be submitted <br />following vegetation sampling. <br />The photo at the left looks west down <br />watershed diversion ditch # 5(WDDS). <br />Permanent ditch PM-5 is currently <br />approved to be reconstructed across the <br />revegetated area in the right-center of the <br />photograph. The landowner would prefer <br />that flow be permanently diverted by <br />WDDS. If EFMC agrees then realignment <br />of PM-5 to this location will be required <br />through revision to the permit. <br />
