Ndvy MD, MPH <br />Fzeative Oin,~r <br />We aze in receipt of a copy of your reclamation permit application, as sent by you to the Colorado <br />Division of Minerals and Geology (formerly the Mined Land Reclamation Division). As you may be <br />aware, EPA has recently instituted a stormwater program, designed to control stormwater runoff from <br />certain categories of industrial activity. Your facility falls under one of these categories. Our records <br />indicate that you have not applied for or obtained a stormwater permit for the above-referenced mining <br />operation(s). <br />in 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges <br />from mining sites (and other industries) as requiring Clean Water Act controls. In 1990, EPA issued <br />regulations that require specific mining activities to obtain pen~r-its in order to discharge stormwater <br />from their facilities. The deadline for submitting such applications for existing facilities was <br />October 1, 1992. However, since many potential permittees are unaware of the program, the Division <br />is still accepting late applications at this time. <br />The stormwater regulations apply to active and inactive mines, if runoff contacts overburden, raw <br />material, intermediate or finished product, or waste products, and leaves the site. (FIowever, if all <br />nuio,Q'from the mine site is contained on the site, with no discharge off-site, a stormwater permit is <br />not required.) <br />The Water Quality Control Division of the Colorado Health Department has direction and authority to <br />administer this program in Colorado.
