In either case the <br />operator must commit to following the plan, commence that activity and provide evidence of <br />such commencement, by the date shown on the last page of this report. <br />There are still many acres to be topsoiled, according to the plan. The plan calls for the <br />pit to be allowed to fill with water at the conclusion of mining. However, the operator <br />stated that this site will not become a pond, but will continue to be used for stockpiling <br />materials and processing operations into the distant future. If the pit is not going to <br />become a pond (which will require that it be dewatered indefinitely), and if any portions <br />of the slope surfaces are not be revegetated (in particular, where permanent facilities <br />are located), the operator should revise the reclamation plan and post-mining land use for <br />the permit. This is required since the future of the site will be different than what was <br />originally approved. This may affect the permit in several ways: the bond amount will <br />likely be able to be reduced, there should be no "problems" of not following the <br />reclamation plan, and if the existing use of the site is the same as future post-mining <br />land use, then those portions of the permit area might be eligible for release. This last <br />part will be affected by whether the site will process only material from off site, which <br />seems assured since this pit is mined out. <br />The last item to report is the topic of "topsoil". It is noted as a problem on page one. <br />The site contains insufficient amounts of stockpiled topsoil for reclamation under the <br />existing plan. As mentioned above, there is an adjoining permitted site which supplies <br />this one with process material. That adjoining site contains a surplus of topsoil, which <br />the operator stated will be used on this site. This condition is not described or <br />approved in either permit file. The operator should submit such a statement of commitment <br />to salvage topsoil from that site, and stockpile it on that site, until such time that it <br />is to be used on this site. The statement should include volumes needed, map of locations <br />where stored, methods of protection during stockpiling, and areas where it will be <br />respread. For the purposes of this importing of material for reclamation, please refer to <br />the Notice requirements in Rule 3.1.5(9).
