-~L <br />2 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear <br />represented the operator. <br />Roads <br />The operator recently re-sealed the paved haul road. The operator also paved the office parking <br />lot and the road leading to the upper parking lot. The roads were in excellent shape. The main <br />haul road guard rail and the berm along the gob pile haul road were functional. The section of <br />old highway 133 in front of the mine entrance was also in good condition. The operator installed <br />a sprinkler at the entrance to the lower coal stockpile bench to water the road in order to cut <br />down on fugitive dust. There were no problems with fugitive dust along old highway 133. <br />Facilities <br />There were no problems at any of the facilities. <br />The operator had just finished moving the longwall. There was not a lot of stockpiled coal on the <br />lower coal stockpile bench or on the upper portal bench. The operator has installed a dirt berm on <br />the outer edge of the lower coal stockpile bench to make sure that coal does not get onto the <br />highway. A drain culvert was installed on the portal bench because one area of the bench was <br />difficult to drain. The culvert drains into the rock-lined down ditch. <br />Hydrology <br />There was very little water in pond B, all of which came from road cleaning. The operator is <br />preparing to de-water pond C for cleaning. Water from pond C may be moved to Pond D. Pond <br />D was dry. All of the pond embankments were geo-technically and erosionally stable. <br />All of the culverts and ditches were functional. Although still functional, culvert C-C 1 1 needed a <br />little cleaning, which the operator did before the inspection was over. Also, straw bales need to <br />be replaced soon in the ditch that is in front of the coverfill stockpile. <br />Silt fences were up south of pond B and to the east of the mine entrance and were functional <br />
