III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. -The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or _ <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on Mazch 29, 2004 by Mike Boulay of <br />the DMG. Roy Kazo of Seneca Coal Company was present during the entire inspection. <br />Weather conditions were sunny and cool. Ground conditions were wet due to recent <br />precipitation that occurred over the previous weekend. Some azeas of the site were still snow <br />covered. Coal was not being hauled from the mine site and the dragline was down for repairs at <br />the time of the inspection. <br />Haul Roads <br />Haul Road A was in good condition and mostly dry. Ditches along Haul Roads A and B were <br />flowing. Haul Road B was very muddy. A track hoe was working on the upper portion of Haul <br />Road B to build up a safety berm for haul trucks. Haul Road D was not accessible due to very <br />muddy and saturated road conditions. The active pit azea and scraper pit were accessible. <br />Hydrologic Balance <br />The North Pit was not accessible due to muddy and saturated ground conditions. Post Mine <br />Channel YPM-10 was inspected from Haul Road B. Runoff from this drainage channel exited <br />the channel and has caused some rills and gullies to form near the lower portion of the channel. <br />As soon as weather permits, please repair the erosion that has occurred at this location: <br />Sedimentation Ponds 010, 013 and 014 were viewed from a distance due to poor access into <br />these locations. Pond 010 was full and dischazging. Ponds 013 and 014 were retaining a <br />significant amount of water but were not dischazging. Some minor erosion is beginning to occur <br />in the northern Pond 014 inlet. Please continue to monitor this inlet for signs of increased <br />erosion. If necessary, take appropriate measures to stabilize the pond inlet and reduce erosion. <br />Backfill & Gradine. Topsoil, and Reveaetation <br />Cessation Order CO-2003-012 was issued on October 22, 2003 for failure to complete <br />reclamation required by the approved plan contained in the permit application package; and <br />failure to complete backfill and grading, topsoil redistribution, and seeding for all azeas of the <br />Yoast Mine in accordance with the backfill and grading plan and schedule depicted on Exhibit <br />19-1A (Abatement Steps I and 2 of NOV CV-2003-007). Backfilling and grading, topsoil <br />redistribution, and seeding has been completed in the North Pit. The remaining location for <br />which the cessation order applies is the azea designated for backfill and grading in 2001-2002 as <br />shown on Exhibit 19-1A. Backfill and grading work has been completed at this location since <br />the issuance of the cessation order. This location was viewed during this inspection. The <br />
