(303) 444215 i <br />June 12, 1989 ~` `` - ~- <br />1 ;?"~I <br />Ms. Cathy Begej <br />Mined Land Reclamation Division ;~!_~ <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Dear Cathy: <br />The following is Walden Coal Company's response to your inspection <br />report dated May 18, 1989, which was given to Kay James on May 24, <br />1989. <br />•Walden Coal believes the alternative sediment control system which <br />was implemented at the Bourg Property during the Fall of 1988, has <br />operated as designed. The rilling that occured on the property is <br />minor and will continue to be monitored. <br />There were several discussions about the best approach to <br />repairing the northwest edge of the reclaimed area where two rills had <br />formed due to runoff from a ditch which ends in a Swale above the area <br />in question. Your original suggestion of placing hay bales across the <br />road was unacceptable for two reasons. First, there has been evidence <br />of people using the perimeter road around the Bourg property. If the <br />road is blocked with bales, we are concerned that an alternative route, <br />across the reclaimed area or through Mann Draw may be taken. Also, hay <br />bales at the end of rills do not serve the dual purpose of the <br />alternative sediment control system which is not only Lo reduce <br />sediment but also to retain topsoil on the revegetated site. <br />Kay discussed the alternative of rerouting the water across the <br />perimeter road and off the property with you. Although this idea was <br />originally accepted, after some discussion we determined that rerouting <br />the water across the road would create the same problems as the hay <br />bales since the water would, more than likely, wash out the road. <br />After a phone conversation between you and Kay, it was determined <br />that stabilizing one of the rills by cutting a shallow V-ditch and <br />placing several rock check-dams along the length of the ditch would be <br />acceptable to the Division. The ditch was constructed as approved and <br />the second rill has been fill. It should be noted that the solution <br />which was finally approved was the one Walden Coal originally proposed <br />and is consistent with the approved alternative sediment control plan. <br />
