CYCC TCC 5/93 page <br />the inspection requirements of the Colorado program. The decision not to require <br />these inspections and certs was based on the fact that the ponds are constructed <br />after reclamation as stockponds for the post-mining land uses of range land and <br />pasture. After this became a TDN issue, twice referred to OSM-HO for review, <br />DMG is now requiring the operator to meet all impoundment regulations. The <br />abatement measures are to provide the as-builts and begin quarterly inspections <br />with the abatement date set as 8/25/93. <br />There were a number of conditions that constituted a violation, but the operator <br />~ fixed the problems prior to the end of the inspections. As such, NOV's were not <br />issued for these problems. <br />An 18" CMP has apparently been in place under the access road that <br />runs in front of pond F for some time. There are designs for the CMP, but it is not <br />shown on the approved maps. This structure was added to the maps. <br />CMP's at the entrance to the new bathhouse location are designed, but <br />are not shown on the approved maps either. These were also added to the maps. <br />CYCC posted stream buffer zone signs along the creek near pond B. <br />Signs had been posted along the creek on the other side of the access road, but <br />not on the south side. <br />An undesigned CMP existed at the entrance to the coal stockpile. This <br />CMP was pulled out. <br />There were also a number of conditions that are not in violation yet but exhibit <br />signs of developing into violations. <br />The CMP to the first in the series of ponds identified as pond B appears <br />as if it may be starting to pipe. CYCC should examine this and fortify the headwall <br />as necessary. <br />The chemical storage area near the 1,000,000 gallon tank is bermed to <br />catch any spills. It appears as if some disturbed areas could drain to this location. <br />CYCC should ensure that this area does not become an impoundment. CYCC <br />stated that their intentions were to reclaim the area during this season. <br />The inlet to pond M is starting to erode. <br />The high road to Eckman Park that parallels the rim has two areas that <br />show signs of instability. CYCC should examine these locations and ensure that <br />the required static safety factor required for permanent roads has been attained. <br />
