Rollings, 370, OSM <br />Dave Berry, DMG <br />Marcus Middleton, CYCC and TCC <br />TCC is a subsidiary of CYCC and the two share a great deal of the facilities areas. <br />CYCC is a reclaimed surface mine and TCC is an underground mine, in part, <br />driven in from the final pit of the surface mine. The narrative for these two mines <br />is combined because of the common features, corporate relationship, and the <br />method in which the sites were inspected. The inspection of Mine #2 was a short, <br />drive through because of the impending bond release inspection. <br />Enforcement Actions <br />Two DMG representatives had conducted an inspection the week before this <br />oversight inspection. There were three outstanding DMG NOV's at the start of this <br />inspection that had been issued last week: C-93-078 for failure to protect topsoil, <br />C-93-079 for maintenance of drainage and sediment control measures, and C-93- <br />80 for discharging water out of an emergency spillway. All of the NOV's were <br />abated during this inspection. The topsoil NOV addressed two areas. CYCC <br />dressed up and seeded the areas. The sediment control measures NOV <br />addressed eight areas for which various types of repairs were necessary; cleaning <br />out CMP's, ditches, check dams, etc. The pond discharge NOV addressed one <br />pond. There was no discharge from the emergency spillway during this inspection. <br />DMG issued one NOV, C-93-82, as a result of this inspection for failure to conduct <br />and provide as-built certifications and failure to conduct and provide required post- <br />construction inspections for the various livestock water impoundments located <br />throughout Eckman Park, Mine 1, and Mine 2. There are about 57 ponds covered <br />by this NOV. DMG had not previously required the ponds to be certified or meet <br />
