III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on May 20 and May 21, 2003 by <br />Mike Boulay of the DMG. Lori Smith of Seneca Coal Company was present during the entire <br />inspection on May 20 and Bob Shevling of Seneca Coal Company accompanied DMG on <br />inspection on May 21, 2003. Weather conditions on both days were sunny and cool. Ground <br />conditions at the mine site were dry. Coal was being hauled from the mine and the dragline was <br />operating in the Yoast south azea. <br />Availability of Records <br />All required records were on file and available for review at the mine site office. No problems <br />were noted with the records review. Please see the attached Availability of Records checklist. <br />Roads <br />Road ditches along Haul Roads A and B were recently bladed and were well maintained. Road <br />ditches and road drainage runouts were dry. A water truck was being utilized for dust control <br />purposes along Haul Road A. <br />The upper end of the slide that has occurred above Pond 012 has encroached very close to the <br />Haul Road D embanlmtent. Because of this, DMG requested that Haul Road D be blocked off on <br />both ends, on either side of the slide azea. Although Haul Road D has not been used for several <br />months, the DMG recommends that Haul Road D remains blocked off until the slide area has <br />been fully mitigated (see Slides and Damage below). <br />Road grading operations have temporarily prevented access to the North Area pit. The road <br />should be reopened so that topsoil redistribution operations can continue in the North Area pit. <br />The North Area pit could not be inspected at this time. <br />Hvdrologic Balance <br />Sedimentation Ponds 010, 011, 012, and 014 were full and dischazging water at the time of the <br />inspection. Inlets, dischazge structures and embankments were in good condition at Ponds 010, <br />011, 012, and 014. <br />Culverts along Haul Road A and Haul Road D were clear of sediment and debris and functioning <br />as intended. Culvert YB-1 will require maintenance. Culvert YB-1 located south of Pond 010 is <br />plugged with sediment on the outlet side. The ditch below Culvert YB-1 has been cleaned and <br />
