III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The shop\warehouse area has been graded to AOC. The reclaimed area <br />is similar in grade characteristics with undisturbed areas <br />immediately up gradient. The area is well vegetated. The sewage <br />lagoon has been filled in. The operator stated that the sewage <br />lagoon vent pipe will be taken out within a week. Also, the <br />operator stated that U.S. West has been notified that the telephone <br />junction box needs to be removed, <br />The shop\warehouse area drains to pond 3 by way of the natural <br />slope and two collection ditches. The two collection ditches were <br />functional. A diversion ditch keeps upland runoff from the west <br />from going onto the reclaimed area. The bond release Map No. i <br />needs to be updated to show the true extent of this diversion <br />ditch. The water level in pond 3 was 3 feet below discharge. The <br />primary and emergency trickle tubes were clear. Pond inlets were <br />protected. Sediment survey stakes were up. If the operator wishes <br />to include pond 3 in the Phase 1 bond release, then the north <br />inslope of pond 3 should be given a more gentle slope than what is <br />out there now. <br />The diversion ditch flow passes through a ranch road culvert before <br />joining with the pond 3 discharge. Thi; combined flow passes <br />through the west mine entrance road culvert and down county road 53 <br />culverts and ditches until it goes off of the permit area. These <br />culverts and ditches were functional. <br />TOPSOIL 6TOCRPILE C <br />The Division is assuming that topsoil stockpile C belongs to <br />Colorado permit no. C-80-003. The operator has mentioned the <br />possibility that this pile has appeared on H-G Mine maps, but was <br />never used by the mine. Examination of pre-mining maps may clarify <br />this issue. Also, the operator is questioning whether this is <br />actually a topsoil stockpile. <br />If this topsoil stockpile is to be included in this Phase 1 bond <br />release, then the bond release package needs to be updated. The <br />stockpile area needs to be delineated on bond release Map No. 1 and <br />a typical cross section needs to be added to bond release Map No. <br />2. The bond release package discussion also needs to include this <br />stockpile. <br />4 <br />
